Terms of Use

These terms are an agreement between you and RaGamez LLC, a California limited liability company ("RaGamez", "we", "us"). They cover ragamez.com, the Portal World and the games and online play on the site (together, the "site"). By using the site, you agree to these terms, our Privacy Policy and our Community Rules. If you don't agree, please don't use the site.

Kids: if you're under 18, ask a parent or guardian to read these terms with you. If you're under 13, ask a parent or guardian before playing online. Parents and guardians are responsible for how their children use the site.

1. Using the site

The site is free. We give you a personal, non-commercial, revocable permission to use it, as long as you follow these terms. We may change, pause or stop any part of the site at any time, including online play and the games.

2. Playing online

• When you play online, other players can see your character, what it does and your random name. Chat with strangers is limited to ready-made phrases. Typed chat is only in private rooms.
• You agree to follow the Community Rules. If you break them, or these terms, we may mute, remove or block you, close rooms, or end your access, without notice.
• What other players say and do is their responsibility, not ours. We use filters, limits, mute and report to keep things friendly, but we can't promise that every player will behave, or check everything in real time. If something goes wrong, use Mute, Report or Go offline, and tell us.

3. Things you must not do

• Bully, threaten, harass or scare anyone, or use hateful, sexual or violent language.
• Use the game's fights to pick on someone: following one player around to knock them out again and again, or chasing anyone who wants to be left alone.
• Share, or ask for, anyone's personal details: real names, addresses, schools, phone numbers, emails, photos, passwords or usernames for other apps. Don't try to get around the chat filter.
• Pretend to be someone else, including RaGamez or a parent, teacher or official.
• Try to meet or contact other players outside the site, or use the site to harm a child in any way. We'll report this kind of behaviour to the police.
• Cheat, hack or modify the game. That includes sending data the game wouldn't send, using bots or scripts, or getting around rate limits, server limits or bans.
• Attack, overload, scrape or test the security of the site or our providers, or upload malware.
• Copy, sell or reuse our games, characters, art, music or code, except as the law allows.
• Use the site for advertising, spam or anything illegal.

4. What you send

You keep any rights you have in your chat messages. So that online play can work, you let us carry, display and briefly store them as described in the Privacy Policy. We may block or remove any message.

5. Our content

RaGamez owns the site and everything we made for it, including:

• the Portal World, Wendigo Run, Arena and Bruja Run
• the characters, story and art
• the RaGamez name and logo

Some models, textures, sounds, animations and code were made by others and are used under their licenses. They're listed on our Credits page. Nothing in these terms gives you ownership of any of it.

6. Items and progress in the game

Characters, weapons, emotes, items and progress in the Portal World are part of the game, not property. They have no money value and can't be sold or traded for money. Progress is saved on your device, so it can be lost if browser data is cleared. We may change, rebalance or reset items and progress.

7. Health and content

• Seizure warning: a very small number of people may have seizures when exposed to flashing lights or patterns, including in video games, even with no history of epilepsy. If you or your child has epilepsy or has had a seizure, check with a doctor before playing. Stop playing at once and see a doctor if you feel dizzy, have altered vision, eye or muscle twitches, loss of awareness, confusion or convulsions.
• Take regular breaks.
• Play somewhere safe, and keep an eye on your surroundings.
• Content: the Portal World includes fantasy weapons, such as swords and guns, used on targets, straw dummies, barrels and wild animals, and wild animals (wolves and a dragon) that can attack players. Online, players' weapons can also knock each other out, except in the safe zones round the plaza and the arrival meadow. There's no blood: a player who runs out of health falls through a portal to the Underworld and finds the way back. Parents decide what's right for their family.
• Age ratings: our games show an age rating, and some are made for teens or adults. Before those start, we ask for your year of birth. Answer it truthfully, and don't play games rated above your age.

8. Other sites

Links to other sites and stores, such as Google Play, are for your convenience. Their own terms and policies apply there, and we aren't responsible for them.

9. Copyright complaints

If you believe something on the site infringes your copyright, email us at raffogamez@gmail.com with:

• a description of the work and where it appears on the site
• your contact details
• a statement that you believe in good faith that the use isn't authorized
• a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner
• your physical or electronic signature

We'll respond quickly, in line with the Digital Millennium Copyright Act. We'll block anyone who repeatedly infringes.

10. Disclaimers

The site is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including that the site will be uninterrupted, error-free, secure or suitable for any purpose, or about anything other players do or say.

11. Limit on our liability

To the fullest extent the law allows, RaGamez and its owners won't be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, progress or goodwill, arising from the site or these terms. Our total liability for any claim about the site is limited to $50.

Some places don't allow these limits, so some of them may not apply to you. Nothing in these terms limits liability that can't be limited by law.

12. If you break these terms

If you're an adult and your breach of these terms, or misuse of the site, leads to a claim against us, you agree to cover our reasonable costs and losses from it.

13. Disagreements

If you have a problem with the site, please email us first. Most things can be sorted out quickly. If we can't resolve it within 30 days:

• California law governs these terms, without regard to conflict-of-law rules.
• Any dispute will be decided in the state or federal courts located in California, or in small claims court where it qualifies.

14. Changes and the rest

We may update these terms. We'll post the new version here with a new date, and using the site after that means you accept it. If any part of these terms can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given up the right to do so later. These terms, together with the Privacy Policy and Community Rules, are the whole agreement between you and us about the site.
